Tragic Incident and Legal Fallout

The tragic event unfolded on September 28, 2023, during a sewer tunnel rehabilitation project managed by D’Arcy & Harty Construction, Inc. Workers had excavated an eight-foot-deep trench near Divisadero and Oak streets that completely lacked essential structural supports.

When a passing vehicle caused the unsupported walls to cave in, twenty-five-year-old worker Javier Romero was buried and tragically died of mechanical asphyxia. State inspectors subsequently revealed that the site flagrantly violated established excavation codes and safety mandates.

Charges and Ongoing Proceedings

In response to the fatal lapse in judgment, prosecutors have filed involuntary manslaughter and safety violation charges against three company officials and their employer. The defendants named in the case include project manager John William Tobin, site safety representative John Finbarr Darcy, and crew foreman Filiberto Poblano Perez.

Investigators also uncovered that the construction firm had received a prior safety complaint regarding an inadequately supported trench at a separate location just three weeks earlier. While legal proceedings continue to unfold, some defendants have pleaded not guilty and surrendered their passports under strict supervision conditions.
